La ripugnanza del Diritto Romano per la fiducia, un'altra ragione, anche più forte, per la sua pro scrizione in diritto moderno, deve vedersi in questo: il testa mento e tale atto che non può assolutamente abbandonarsi ad attacchi così facili e pericolosi, specialmente quando nessuna pa rola faccia supporre un erede diverso da quello iscritto; non solo la fiducia rimetteva alla volontà.
